The North Dakota House of Representatives will soon vote on HB 1478 which would expand the current State Children's Health Insurance Program.   A conference committee met today on the bill, and we need to urge Representatives to support the Conference Committee report, which expands the program to cover children of the working poor who do not have health insurance up to 200% of the federal poverty level.

No Voice at the Table?

North Dakota Legislative Assembly to nonpublic schools:

  • You can’t open a school without state approval;
  • We will tell you what subjects you must teach;
  • All of your teachers and principals must be licensed by the state;

Oh, and one more thing -- you can’t have a seat at the table when it comes to deciding the future of North Dakota’s educational system.

That is apparently the view of some legislators who are resisting allowing a representative from nonpublic schools to sit on the new North Dakota Commission on Education Improvement - even as a nonvoting member.

The commission is part of the massive House Bill 1400, a major overhaul of the state's education system. The Senate Appropriations Committee saw the justice involved and added a nonvoting representative from the nonpublic schools to the commission. Some legislators, however, oppose having any nonpublic representation on the commission.

Contact HB 1400's conference committee members and urge them to support including a nonpublic school representative on the Commission for Education Improvement.

Governor Signs Abortion, Human Trafficking Bills

On April 8, Governor Hoeven signed into law:

  • SB 2265, which requires a notice to be posted at abortion facilities informing women of the right not to be coerced into an abortion; and
  • SB 2209, which prohibits human trafficking.

Senate Passes Pro-Life Legislation

The North Dakota Senate passed two bills and a resolution concerning abortion.

HB 1445, which requires that before a woman consents to an abortion she is informed that the abortion will terminate the life of a whole, separate, unique, living human being, passed 34 to 11.

HB 1371, which requires that a woman be given an opportunity to view an ultrasound before consenting to an abortion, passed 44 to 1.


HCR 3015, which expresses the Legislative Assembly's opposition to the Freedom of Choice Act, passed by a voice vote.


House Defeats Threat to Religious Liberty

The state House of Representatives defeated SB 2278, which would have added sexual orientation to the state’s Human Rights Act without adequately protecting religious liberties. The vote was 34 to 54.

Urgent Action Alert: Religious Liberty Threatened by Sexual Orientation Bill

SB 2278 would add “sexual orientation” to the North Dakota Human Rights Act, giving sexual expression and sexual activities protected status under the law. The proposal raises troubling religious liberty concerns for churches as employers and providers of educational and social services, and to all individuals whose religious beliefs do not condone homosexuality or other sexual acts outside of marriage. Tell your state representatives not to discriminate against you and your religious beliefs. Ask them to vote NO on SB 2278. (Read more on why SB 2278 threatens religious liberty.)

Why Does Senate Bill 2278 Threaten Religious Liberty?


Senate Bill 2278 adds “sexual orientation” to the North Dakota Human Rights Act, making it a protected class under the law in matters of employment and public accommodations. The definition of sexual orientation is ambiguous enough to extend to sexual acts and expressions. Public accommodations includes most services, including private education, rental of church and school meeting rooms, and use of Knights of Columbus halls. Many people and religious bodies do not approve of homosexuality and other sexual activities outside of marriage. Senate Bill 2278, however, does not protect churches or employers from being forced to violate their religious beliefs.

Doesn’t the bill have religious exemptions?

At first glance, SB 2287 appears to exempt religious entities, but a closer look reveals that the exemptions are not exemptions at all. Only one of the “exemptions” applies to matters involving sexual orientation and it is so narrowly drawn that it only applies to employment for “religious positions.” It does not apply to other personnel, such as school employees, and it does not apply at all to public accommodations.

The other “exemptions” thrown into the bill
do not apply to matters involving sexual orientation.

In short, Senate Bill 2278 contains no real protection for religious entities from claims of discrimination based on sexual orientation (which includes sexual activities), whether it be in employment matters or public accommodations.

The state legislature will take up several important bills when it returns from the flood-fighting recess. Now is the time to contact your legislators on these bills.

Senate Bill 2278 - Adds Sexual Orientation to Human Rights Act


The bill goes to the House floor for a final vote next week.

While the Catholic Church condemns arbitrary discrimination and prejudice against a person because of sexual attraction, the North Dakota Catholic Conference opposes this bill for several reasons.

  • The bill contains no real protections for religious entities
  • The bill contains no protections for faith-driven organizations not owned by churches
  • It does not expressly exempt youth and scouting organizations
  • The bill’s definition of “sexual orientation” encompasses acts, including sexual acts outside of marriage
  • Existing law already protects workers engaged in lawful activities outside of work

Contact your Representatives and urge them to vote No” on SB 2278. Let them know you do not condone unjust discrimination because of sexual attraction, but that SB 2278 is a bad bill.

The Human Services Committee restored the Governor’s recommendation to expand coverage to 200% of the federal poverty level. The bill is now being reviewed by the Senate Appropriations Committee.

More information about SB 2283:

  • North Dakota ranks at the bottom among states when it comes to providing prenatal care to low-income women and their unborn children.
  • The bill only extends coverage to pregnant women at less than 165% of the federal poverty level.
  • Most of the funding for the bill comes from federal sources.
  • Coverage does not include abortion.
  • Mothers who do not receive prenatal care are three times more likely to give birth to a low weight baby and their baby is five times more likely to die.
  • In Catholic teaching, a person’s access to basic health care should not depend on how much a person earns. This is especially true for the unborn child, who should not be denied health care because his or her mother cannot afford it.

Catholic Bishops Voice Support for Pro-Life Bills

Bismarck, North Dakota - Speaking at the state capitol in Bismarck, North Dakota’s Roman Catholic bishops affirmed their support for state legislation to protect unborn human life, including a modified version of the “personhood” bill.

In a joint statement released at the event, Bishop Paul A. Zipfel of Bismarck and Bishop Samuel J. Aquila of Fargo reaffirmed their “steadfast commitment to defending human life from conception to natural death” and urged passage for legislation that would bring the state closer to ending abortion and to establishing legal protection for all unborn children.  “The people of North Dakota, through their public officials, have steadily and strategically advanced the cause for life, making the state one of the most pro-life in the nation,” the bishops said.

The bishops stated that several bills introduced this legislative session provide “another opportunity to move forward.”  The bishops expressed support for House Bill 1445 which requires that a woman considering an abortion be told that the abortion will terminate the life of a whole, separate, unique, living human being, HB 1371, which gives a woman an opportunity to view an ultrasound of her unborn child, SB 2265, which helps ensure that women are not coerced into abortions, and SB 2391, which improves the successful alternatives-to-abortion program.  The bishops also voiced their support for House Concurrent Resolution 3015, which expresses the legislature’s opposition to the Freedom of Choice Act.

Discussing House Bill 1572, which some have called the “personhood” bill, the bishops proposed a set of amendments to remedy perceived problems with the bill’s current language.  After consulting with various experts, including some with extensive and lengthy experience in abortion law, the bishops concluded that the bill’s existing language raises many unanswered questions, could lead to unintended consequences and injustices, and would not achieve the goal of providing a direct challenge to Roe v. Wade and its progeny.

Expressing support for the bill’s concept, the bishops stated that they could support HB 1572 if it was amended to address the concerns.

Stimulus Mysterious

Question: What do you get when you combine a record budget surplus, a biennial legislature, and millions of dollars of federal stimulus money coming half-way through the legislative session? Answer: A lot of questions.

The Governor and the Legislative Assembly are starting to reexamine everything in light of the economic stimulus money coming from the federal government.

Updates - HB 1445 and HCR 3015 Pass House

The state House of Representatives today passed House Bill 1445 and House Concurrent Resolution 3015.

House Bill 1445 requires that that before a woman consents to an abortion she is informed that the abortion will terminate the life of a whole, separate, unique, living human being. It passed 61 to 31.

House Concurrent Resolution 3015 expresses the Legislative Assembly’s opposition to the Freedom of Choice Act. It passed 65 to 24.

ND Catholic Conference: No Place for Discrimination; No Need for Bill

The North Dakota Catholic Conference testified today that while there is no place for arbitrary discrimination and prejudice against a person because of sexual attraction, a bill to add sexual orientation to the state’s Human Rights Act was unnecessary and flawed in its scope and reach.

The bill, Senate Bill 2278 would add sexual orientation to the list of unlawful discriminatory acts in cases of employment, housing, and public accommodations. The bill, however, provides no exemption for religious entities, private schools, and youth organizations. Moreover, the bill’s definition of “sexual orientation” encompasses more than sexual attraction and could cover sexual activities, homosexual or heterosexual, outside of marriage.

Although the conference cannot support the bill, Christopher Dodson, executive director of the North Dakota Catholic Conference, told the committee that unjust discrimination has no place when it comes to basic human rights, saying:

The Catholic Church affirms the God-given dignity of every human life and rejects unjust discrimination. Acts of violence, degradation, or diminishment toward any human person, including anyone with a homosexual inclination, are contrary to the teachings of the Catholic Church. There is no place for arbitrary discrimination and prejudice against a person because of sexual attraction. We especially deplore violence and harassment directed against such persons. Moreover, all human persons, including those with homosexual inclinations, have a right to obtain employment and housing.

Bishop Exhorts Legislators to Turn to God for Truth and Justice

Only when we turn to God, who is truth, that we are able to approach the foundation of justice said Paul A. Zipfel, Bishop of Bismarck at the biennial Mass for Legislators and Public Officials.

The Mass was held at the Bismarck’s Cathedral of the Holy Spirit on January 29. Held every two years during the North Dakota Legislative Assembly, the event provides an opportunity for legislators and public officials to pray, hear the Word proclaimed, and share in the Eucharist.

Bishop Zipfel preached that there are four propositions that have contributed to the loss of our moral moorings and the increase of secularization in our pursuit of justice within the last century. He identified them as the rise of moral relativism, the rejection of the reality of virtue, the decline of personal responsibility, and the intellectual pride that believes that we human beings can solve the mysteries of life without God.

Bishop Zipfel also acknowledged the challenges faced by public officials and the need for forgiveness after bitter political campaigns. “Some wounds among members of our own church have not yet been healed. We must all pray in a spirit of humility for the forgiveness we need as we exchange a sign of peace at this Eucharistic liturgy,” said the bishop.

Following the Mass, legislators and public officials, including many non-Catholics, enjoyed a dinner with members of the North Dakota Catholic Conference board of directors. The St. Mary’s Blues choir from St. Mary’s Central High School in Bismarck.

ND House Passes Ultrasound Bill

The North Dakota House of Representatives overwhelmingly passed a bill to require abortion facilities to offer a woman the opportunity to view an ultrasound of her unborn child before consenting to an abortion. The bill, HB 1371, passed with 77 yeas, 9 nays, and 8 absent and not voting. Go here to find out how your representative voted. (Search for 1371 or scroll down about half way.)

The House Finance and Tax Committee will consider three important bills on Wednesday (January 14.)

The first is House Bill 1190. This bill allows a North Dakota tax credit for contributions made to nonprofit private colleges or high schools.
Urge Committee Members to Support HB 1190.

The second bill is HB 1200. This bill will take away the property tax exemptions for hospitals and nursing homes and make them subject to local taxes for fire, law enforcement and emergency services. The bill also removes the exemption for group homes, YMCAs and other organizations. The bill would have a major impact on public charities and must be defeated.
Urge Committee Members to Oppose HB 1200.

The third bill is HB 1203. This bill allows North Dakota tax credits for contributions to nonprofit foundations with certain endowments. This will be a major benefit to Catholic schools and other nonprofit organizations. Urge Committee Members to Support HB 1203.

Week One: Addresses and Bill Filing

The Sixty-first Legislative Assembly officially kicked-off on Tuesday. Most of the week's activities consisted of the "State of . . ." addresses, starting with the State of the State address by Governor John Hoeven, followed by the State of the Judiciary on Wednesday, and the State of the Tribes on Thursday.

The Governor spoke about the state's unique position of being one of the few states in the country with a large budget surplus.  He touted the need to use this opportunity to invest in education, tax relief, and health care, including an expansion of the state children's health insurance program.  

Expect legislators to introduce many bills next week.

Governor John Hoeven has released his budget recommendations for the 2009-11 biennium. Among the highlights (as reported by the Associated Press):

MEDICAL COSTS: Reimbursement rates for medical providers, including doctors, dentists and chiropractors, who provide services to Medicaid patients are increased to a higher base level. Hoeven also proposes increasing those higher rates by 7 percent annually.

CHILD HEALTH CARE: North Dakota families with incomes up to twice as high as the federal poverty level would be eligible for health insurance coverage for their children. The current limit for the Children's Health Insurance Program is 150 percent of the poverty level. The proposal would make more than 3,000 children newly eligible for the program.

Hoeven's budget includes $1.1 million in state funds to increase eligibility to 200 percent, which equals an annual income of $42,400 for a family of four. The total added expense is $4.4 million. The remaining $3.3 million would be paid by the federal government.

FEDERAL MONEY: Congress is being asked to provide almost 37 percent of Hoeven's proposed $7.71 billion budget over two years. Federal money provides significant chunks of the budgets of two of the state's largest agencies, the Department of Human Services and the Department of Transportation.

CHILD CARE CHECKS: Attorney General Wayne Stenehjem's office would get $900,000 and authorization to hire five new employees to cover the Bureau of Criminal Investigation's costs for conducting criminal background checks on child care workers.

Legislative Council Chooses Studies for Interim

The Legislative Council has chosen what issues to study before the next legislative session. Included on the list:

- a study of the Temporary Assistance for Needy Families program;

- study how various public and private entities can cooperate with families to promote health lifestyles for children and create awareness about the interplay of healthy lifestyle choices and educational success

- study the feasibility and desirability of establishing a transition to independence program for young adults with mental illness

- study ways in which schools and school districts can train teachers, counselors, and all other school staff to better identify high-risk students and provide programs designed to reduce the incidences of high-risk behaviors that can lead to suicide attempts

Legislative Session Finished!

The 60th North Dakota Legislative Assembly wrapped up late last night. Among the final bills approved was the Department of Human Services budget. It includes a reimbursement increase for providers of health care services to the poor and disabled and some extra help for hospitals that serve a high percentage of medicaid recipients.

Legislature Carries On

At this point, it looks as though this year's legislative assembly is on course to set a record for the longest session in recent history.

The House and the Senate continue to try work out disagreements on property tax, higher education, and other issues. Getting less attention from the press, but still very important is the Department of Human Services budget (SB 2012.) Senators refused to accept a conference committee report that reduced the total funding in the bill to a level less than even the Governor's request. After more consideration, conferees have improved the bill by providing more funding for programs assisting the developmentally disabled and allowing "continuous eligibility" for medicaid recipients.

The latest agreement now goes to the floors of both chambers for approval.

Prison Funding

Conference Committee to Begin Work on Human Services Budget

The conference committee working on Senate Bill 2012, the Department of Human Services budget begins work today. The committee will probably work many days to resolve the differences between the House and Senate versions of this important bill.

Bill Updates

Here's an update on some bills we are still following:

HB 1466 - the abortion trigger ban, is still on the Senate floor calendar, where it has been for a week. Expect the Senate to vote on it next week.

SB 2012 - the Department of Human Services budget. The two chambers will probably appoint a conference committee to meet next week. The Senate members and House members have different priorities with regards to this budget. Working out those differences could take some time. Some of the issues: a payment increase for providers of care to nursing home residents and developmentally disabled persons, continuous eligibility for Medicaid recipients, increased Medicaid support for hospitals, and child advocacy centers.

HB 1463 - expansion of children's health insurance. A conference committee needs to be appointed, which will probably wait until the continuous eligibility issue in SB 2012 is resolved.

HB 1015 - Department of Corrections budget. The Senate restored requested funding to convert temporary positions to two full-time chaplains. The Big Question - whether to build a new prison, remodel an existing prison, or neither - is far from settled. It could be one of the last issues settled this session.

SB 2103 - Coverage of forensic exam costs for victims of sexual assault. This bill passed the House but only after it was amended. It now returns to the Senate.

HB 1472 - Presence of sexual offenders on school property. The Senate amended this bill to address, among other things, suggestions made by the Catholic Conference and the State Association of Nonpublic Schools as to how it applies to church/school property. It now goes back to the House.

Faith-Based and Community Initiatives Moving to Department of Commerce?

The 2005 Legislative Assembly created an Office of Faith-based and Community Initiatives in the Governor's office. The office had no funding and the responsibilities were given to the Governor's Chief of Staff.

This session, it looks like the legislature will move the office to the Department of Commerce and give it some funding. The changes appear in the appropriation bills for the Governor and the Deparment of Commerce.

Activities of Interest - March 23-30

There are no hearings scheduled for next week. The legislators will be focusing on bringing bills to the floor and on conference committees to work out differences between House and Senate versions of bills.

This is a difficult time for the general public and even experienced lobbyists to stay on top of what is happening at the legislature. We will try to post up-to-date information on the website.

Human Services Budget Trimmed - Right Priorities?

The House Appropriations Committee has reduced funding for a long list of items in House Bill 2012, the Department of Human Services Budget. It may take a few days to fully ascertain the impact of the many amendments adopted to the bill, assuming they are included in the bill's final version. Since the Senate version of the bill differs, the bill will end-up in a conference committee for final changes.

Lawmaking, especially when it comes to appropriating state funds, is about prioritizing. The ultimate test of the state's budget is how it effects the least among us. The programs of the Department of Human Services serve those people, particularly those who, for no fault of their own, face unique challenges and disadvantages. We hope and pray that the final budget reflects our obligations to our neighbors most in need.

Catholic Charities Calls for Additional Funding for Adoption Program

Leanne Johnson of Catholic Charities of North Dakota serves as the Adoption Director of the for AASK (Adults Adopting Special Kids).  The AASK program is a collaborative effort between Catholic Charities North Dakota and PATH ND, Inc.  This program contracts with the ND Department of Human Services to provide adoption services for children in the foster care system, many of whom have special needs.  The program provides a wide range of adoption services, including recruitment services, adoption home assessments, adoption placement and post-placement services, as well as post-adoption support services.

Currently, the AASK Program is involved with 160 additional children in various stages of permanency planning, known as concurrent planning.  In addition, the program is actively working to place 85 waiting children for adoption, 15 of whom do not have an identified adoptive family. There are roughly 26 children in adoptive placement awaiting the legal finalization of their adoption.  This reflects a total number of 271 children receiving AASK services.  Furthermore, the program is actively working with 97 families, providing adoption preparation, assessment or placement supervision services.  The program is aware of 84 additional families throughout the state who are awaiting services.  These families have attended the required pre-service training and are awaiting an adoptive home assessment.  It is estimated that at least half of these families are ready to move to the next step of the process, but program staffing limitations are hindering more active involvement.  The program has utilized the services of a contract provider to help meet this need; however, this has not been a solution to the greater problem.  Children and families are still waiting.

House Resources Division of the House Appropriations Committee asking that the committee included the needed additional funding in the Department of Human Services Appropriation Bill (SB 2012.

House Committee Hearing Testimony on Human Service Budget

The Human Resource Division of the House Appropriations Committee continues to hear testimony on the Department of Human Services Appropriation Budget (Senate Bill 2012.) On Wednesday the committee took public testimony on the bill. (Most other testimony is presented by Department representatives.)

The state's budget, particularly the Department of Human Service appropriation, is
moral statement about the state's priorities and its commitment to assisting those most in need. The Department funds many worthwhile programs. A few programs of particular interest to the North Dakota Catholic Conference which are in need of additional funding are:

- reimbursement for most Medicaid providers at an additional 5% per year;

- Medicaid reimbursement for hospitals up to the Medicare reimbursement level;

- additional funding for the Adults Adopting Special Kids program;

- adequate funding for Medicaid and S-CHIP to cover more children who are presently uninsured.

Please contact the committee members and ask them to support these needed additions to
Senate Bill 2012.

Crossover Approaches -- What Remains

Friday, February 16 is "crossover" day. The Senate must act on all Senate bills and the House must act on all House bills by this date. Most of the work next week will be done in the appropriation committees. Those committees must finalize and send out all bills with an appropriation so that the full chambers can vote on them by Friday.

Here are some bills that still need final action before crossover:

SB 2400 -- State policy on childbirth and abortion. The Senate Human Services committee is looking over some proposed amendments. The North Dakota Catholic Conference supports the bill's intent and is waiting to see what comes out of the committee.

HB 1463 -- Expands health care coverage for low income children. To express your support, contact the members of the Human Resources Division of the House Appropriations Committee.

SB 2012 -- The Department of Human Services Appropriations bill. The Senate Appropriations Committee will finish work on this bill this week.

HB 1420 SB 2331 -- The bills addressing the ability of local government bodies to regulate animal feedlot operations. For how the principle of subsidiarity impacts this discussion, go here.

SB 2371 -- Allows grandparents to provide home education, clarifies and revises some language concerning home education. The bill received a Do Pass recommendation from the committee and is headed to the Senate floor.

Senate Passes Department of Labor Name Change

Senate Bill 2121, which would change the name of the Department of Labor to the Department of Labor and Human Rights, passed the Senate yesterday 29 to 18.

Budget Forecast on Tuesday

For some, it is the most anticipated -- or dreaded -- day of a North Dakota legislative session: the day the revenue forecast is released. Unlike other legislative sessions, this year's forecast will come out before the crossover date. This could make it easier for the two chambers to better deal with the appropriation bills still in their committees before they have to send them over to the other chamber.

The forecast will be released on Tuesday, February 6 at 8:00 a.m.

Senate Passes Premarital Counseling Bill

The North Dakota Senate passed a bill to provide a discount in the cost of a marriage license fee for those couples who have received premarital counseling. The bill came out of a interim legislative committee that studied the state's laws on marriage. The bill, SB 2041, 32 to 14. It now goes to the House.

How Frightening is a Name Change?

SB 2121 would do one thing -- and only one thing. It would change the name of the Department of Labor to the Department of Labor and Human Rights. It does not create new "rights," grant new enforcement authority to the state, or change the process for filing allegations of violations of human rights.

Why then, is a name change important? For one thing, the majority of the work now done by the Department of Labor concerns human rights enforcement. A name that reflects the department's actual work makes sense and gives the public an immediately recognizable place to ask about possible human rights violations.

More importantly, an accurate name says something about the state's commitment to protecting basic human rights. The Catholic Church sees the recognition of these rights and their defense as an essential way of recognizing the human dignity inscribed by God on all human persons. See, e.g.
Compendium of the Social Doctrine of the Church, paragraphs 152 - 159. Refusal to make a simple name change dismisses, rather than affirms, these basic human rights.

Contact the Senate Industry, Business, and Labor Committee and ask them to give a "Do Pass" recommendation on Senate Bill 2121.

Special Event Vendors Bill Amended

The House has amended HB 1074 to address concerns expressed by the North Dakota Catholic Conference. The bill would require "special event organizers" to report to the Tax Department information on vendors that sell items at the event. Church organizations often have a events where a small number of vendors, such as booksellers, might be present.

The amendments would make the reporting requirement apply only to events that have ten or more vendors and not at all to events where all the proceeds go to a nonprofit.

ND Legislature Finishes First Week

The 60th North Dakota Legislative Assembly kicked-off this week. Highlights of the week included the Governor's State of the State Address, the Chief Justice's State of the Judiciary Address, the State of Tribal-State Relationship Address by David Brien, Chairman of the Turtle Mountain Band of Chippewa Indians.

Committees held only a few hearings this week. This could be because, as the
Bismarck Tribune reports, the number of pre-filed bills is substantially less than other sessions. Expect bills to start coming in at rapid pace during the next week.
